Terms of Service

1. Acceptance of Terms

By accessing or using getjobwon.com (the "Site") or any of our applications, APIs, or services (collectively, the "Service"), you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

JobWon provides an AI-powered proposal generation platform designed for service professionals, contractors, and tradespeople ("Service Professionals"). The Service includes:

• AI-assisted proposal drafting using photo analysis, voice input, and project details
• Market price reference data for common materials and labor
• PDF export and client-facing proposal delivery tools
• Photo storage, project visualization, and template management
• Account management and business profile features

The Service is intended as a productivity tool only. All proposals generated by the Service are suggestions that must be reviewed and approved by you before use. JobWon does not guarantee any business outcome.

3. User Accounts and Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and not share account credentials with others
• Promptly notify us of any unauthorized use of your account at info@getjobwon.com
• Accept responsibility for all activity that occurs under your account

We reserve the right to disable any account that we believe has been compromised or is being used in violation of these Terms. One account per user; accounts are non-transferable.

4. Subscription Plans and Billing

4.1 Plans and Pricing

We currently offer the following subscription plans (pricing subject to change with notice):

• Solo — $29/month: 1 user, unlimited proposals, AI photo analysis, voice notes + AI analysis, Before/After visualizations, PDF export with your branding
• Team — $79/month: Up to 5 users, everything in Solo, priority support
• Pro — $199/month: Up to 10 users, everything in Team, unlimited visualizations, custom branding, dedicated support
• Enterprise — Custom pricing: Unlimited users

4.2 Free Trial

New accounts receive 30 days free. No credit card is required to start your trial. At the end of the trial period, you must select a paid plan to continue using the Service. Trial accounts that are not converted to a paid plan will have their access suspended. Usage limits may apply during the trial period.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly) unless you cancel before the renewal date. By subscribing, you authorize JobWon (through our payment processor, Stripe) to charge your payment method on a recurring basis. You are responsible for keeping your payment information current.

4.4 Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting us at info@getjobwon.com. Cancellation takes effect at the end of the current billing period. We do not issue refunds for any portion of a billing period already paid, including for unused time remaining after cancellation. After cancellation, you retain access to the Service until the end of your paid period.

4.5 Price Changes

We reserve the right to change subscription prices with at least 30 days' advance written notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing. Founder-pricing commitments, if any, are honored as described at the time of that offer.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Engage in fraud, misrepresentation, or deceptive business practices
• Scrape, crawl, or systematically extract data from the Service
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service
• Share your account credentials with others or allow multiple users to share a single account
• Upload content that infringes any third party's intellectual property rights
• Transmit viruses, malware, or any other malicious or disruptive code
• Attempt to gain unauthorized access to any portion of the Service or related systems
• Use the Service to send spam or unsolicited commercial communications
• Create proposals for illegal services or products

Violation of this policy may result in immediate suspension or termination of your account without refund.

6. Artificial Intelligence (AI) Generated Content

JobWon uses artificial intelligence to assist in generating proposals, pricing estimates, and scope of work descriptions. All outputs are suggestions only. JobWon makes no representations or warranties regarding the accuracy, completeness, or fitness for any particular purpose of any AI-generated content. All pricing estimates are based on regional market data and may vary significantly based on local conditions, material availability, and labor rates. Users are solely responsible for reviewing, verifying, and approving all AI-generated content before sending to any client or third party.

7. Intellectual Property

7.1 JobWon's IP

The Service, including all software, algorithms, user interface designs, logos, trademarks, and underlying technology, is owned by Pro Serve Technologies LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your internal business purposes in accordance with these Terms.

7.2 Your Content

You retain ownership of all content you create through the Service, including proposals, client information, photos, and voice recordings ("User Content"). By uploading User Content to the Service, you grant JobWon a limited, worldwide, royalty-free license to store, process, and transmit that content solely to provide and improve the Service. We do not claim ownership of your proposals or client data.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant JobWon a perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation.

8. Data and Privacy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, JobWon's total liability to you for any claims arising from your use of the platform shall not exceed the total amount paid by you to JobWon in the thirty (30) days immediately preceding the claim. JobWon shall not be liable for any lost profits, lost revenue, lost business opportunities, or any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any AI-generated content produced by it.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless JobWon, Pro Serve Technologies Limited Liability Company (LLC), and its officers, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, any proposal you send to a client using JobWon, or any work performed under a contract resulting from a JobWon-generated proposal.

11. No Professional Advice

JobWon is a productivity tool designed to assist trade contractors in creating proposals. JobWon does not provide legal, financial, contracting, or professional estimating advice of any kind. Nothing on the platform or generated by the platform constitutes professional advice. Contractors are solely responsible for the accuracy of any proposal sent to their clients and for all work performed under any contract entered into as a result of using the platform. JobWon is not a party to any agreement between a contractor and their client.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. JobWon specifically disclaims:

• Any warranty that the Service will be uninterrupted, error-free, or secure
• Any warranty of fitness for a particular purpose or merchantability
• Any guarantee that AI-generated proposals will be accurate, complete, or suitable for any specific project
• Any guarantee that use of the Service will result in winning bids, obtaining clients, or any specific business outcome
• Any warranty that pricing data is current, accurate, or applicable to your local market

13. Termination

13.1 By JobWon

We may suspend or terminate your account and access to the Service, at our sole discretion, with or without notice, for any reason including but not limited to: violation of these Terms, non-payment of subscription fees, fraudulent or abusive use, or if we determine that continued access poses a risk to other users or the integrity of the Service. Termination for cause does not entitle you to a refund.

13.2 By You

You may cancel your account at any time. Upon cancellation, your access will continue until the end of the current paid billing period. After that, your account and data will be scheduled for deletion in accordance with our data retention policy.

13.3 Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately terminate. Provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 9, 10, 11, 12, and 14) shall survive.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Ohio. You waive any objection to the personal jurisdiction of such courts.

15. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or by a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your subscription before the effective date.

16. Miscellaneous

• Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and JobWon regarding the Service.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• Waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
